PRIVACY POLICY
CHANGE HEROES FUNDRAISING INC.
As amended and restated on: May 26, 2015
This Privacy Policy (the “Privacy Policy”) is incorporated with the Change Heroes Terms of Use Agreement (the “Agreement”), as amended from time to time and found here: https://changeheroes.com/privacy. Unless defined herein, capitalized terms have the meanings assigned to them in the Agreement.
This Privacy Policy describes how Change Heroes collects, protects, uses, and discloses data through your use of the Services. By using the Services, you (“you”) expressly consent to the processing of your data according to this Privacy Policy.
THIS PRIVACY POLICY IS SUBJECT TO THE PERSONAL INFORMATION PROTECTION AND ELECTRONIC DOCUMENTS ACT (CANADA). TO THE EXTENT THAT ANY INFORMATION COLLECTED THROUGH OUR SERVICES IS STORED IN THE UNITED STATES, YOUR INFORMATION MAY ALSO BE SUBJECT TO OTHER U.S. LAWS. FURTHERMORE, DEPENDING ON WHERE YOU ACCESS AND USE THE SERVICES, YOU MAY BE SUBJECT TO LAWS APPLICABLE TO YOUR SPECIFIC JURISDICTION. YOU ACKNOWLEDGE AND AGREE TO FAMILIARIZE YOURSELF WITH SUCH ALL LAWS APPLICABLE TO YOU, AND ADHERE TO THEM AT ALL TIMES.
INFORMATION YOU PROVIDE. Further to the Agreement, in using the Services, you may provide us with the following information (collectively, Profile Information, Campaign Information and Administrative Content is defined in the Agreement as “User Content”):
“Profile Information” which may include your name, your company’s or organization’s name (if applicable), a user ID, a profile photo, your contact information (which may include telephone number, e-mail address, and mailing address), and any other information which may be personally identifiable and collected by us from time to time.
“Campaign Information” which includes any and all content and information provided through your use of the Campaign Services, which may include:
your choice of Project;
your list of Campaign friends, including their names, e-mail addresses, and any other information we may request and which you may provide from time to time;
your Videos;
the contents of, and the details relating to, the customizable messages sent to your Campaign Friends;
metrics relating to your Videos, such as view count;
your use of the Campaign Services to manage and promote the Campaign; and
any other information you provide to us in the course of managing Campaign.
“Administrative Content” which includes any and all content and information provided by an Administrative User through their use of the Administrative Dashboard, and the Services generally.
AUTOMATIC COLLECTION. We automatically collect information about how you use the Sites and Services, the areas of our Sites that you visit, as well as information about your computer or mobile device, such as your Internet protocol (IP) address, device ID, physical location, browser and operating system type, and referring URLs. This information is necessary for providing personalized and location-based content as well as for analyzing web traffic, troubleshooting problems, preventing fraud, and improving the Services. We link this data to the personally identifiable information we collect about you.
THIRD PARTY DATA. If you choose to sign in with your Google account, LinkedIn account, Facebook account or some other similar site which we may support from time to time, we will import the requested information from your third party account (the “Third Party Data”). You understand that your Third Party Data continues to be primarily governed by the terms of use and privacy policy of the third party that facilitated its access and sharing. We do not control Third Party Data, but are only given limited access to it to provide you convenience in service. At any time, you may revoke that limited access to your Third Party Data from the respective third party’s website. For certainty, this Privacy Policy does not apply to Third Party Data.
BILLING INFORMATION. Further to the Agreement, to make a Donation to a Campaign, you may be required to provide some or all of the following information: your full name, your payment information (such as credit card information, or any information relating to any other method of payment we may accept from time to time), your Donation amount, your Donation type (whether Recurring Donation or One-Time Donation), your Campaign choice, your associated Project choice, your billing address, your e-mail address, and any other information as may be required by Change Heroes from time to time in order to process your Donation (the “Billing Information”).
Because we use a Payment Processor in order to facilitate payments, Billing Information is not stored on our system. As a result, your Billing Information is not governed by the Agreement or this Privacy Policy but is governed by such Payment Processor’s terms and conditions. You will be notified of the applicable Payment Processor at the time of Donation.
Collectively, all information that you may provide, as contemplated under this Section 1, shall be referred to as: “Your Information”.
OVERVIEW. We collect, use and disclose Your Information in order to (i) provide you with the Services, (ii) operate and improve the Sites, (iii) create a positive User experience, and (iv) to facilitate our compliance and our Partners’ compliance with laws applicable to charitable fundraising.
CONSENT. By providing us with Your Information, you consent to our using Your Information to:
provide you with the Services;
provide you with customer support, as applicable;
create and manage a Campaign;
facilitate your charitable fundraising activities;
provide our Partners with information relating to their Project supporters;
prevent potentially prohibited or illegal activities;
enforce the Agreement and this Privacy Policy;
customize, measure, and improve our Services, and the Sites’ content and layout;
contact you about feature updates, and informational and service-related communications, including important updates;
contact you with relevant third party offers to which you expressly subscribe (you may unsubscribe anytime);
publicly promote your Campaign;
conduct marketing and promotional activities, and conduct surveys, case studies, and blog engagement;
contact you with Project Updates, and news relating to any Partner, Project or Campaign; and
provide Campaign Runners with a Campaign Dashboard, with access to Donor information, for the purpose of facilitating the management and promotion of a Campaign.
OVERVIEW. The Services were built to facilitate personalized, peer-to-peer online fundraising. Further to Section 2.1, we designed Your Information to be shared so that this kind of engagement can be facilitated. We are mindful that Your Information may be highly sensitive in nature, and have therefore developed the Services so as to protect Your Information’s privacy and security while still allowing it to be used for the purpose of facilitating these engagements.
CAMPAIGNS. Each time you create a Campaign, you provide User Content. You understand that, subject to your privacy settings, some or all of your User Content may be viewed and shared by your Campaign Friends, and publicly. You understand that all Campaigns are publicly viewable. In providing your User Content, you consent to such use.
PARTNERS. Each time you make a Donation, we share parts of Your Information with the Partner associated with your chosen campaign. Such information may include your Profile Information and Billing Information. We do this to assist the Partner with their regulatory requirements of keeping donor records for tax and audit purposes. Any information provided to the Partner for this purpose may held by the Partner for so long as the Partner, in good faith, requires for its legal compliance to be fulfilled.
THIRD PARTY SERVICE PROVIDERS. We share Your Information, or parts thereof, with third parties who help deliver our Services to you. Such products and services provided by these third parties include: web server hosting, database storage, data analysis, marketing assistance, credit card payment processing, and website analytics. These third parties may have access to Your Information, or any part thereof, as is necessary to perform their functions, but they may not use that data for any other purpose. We will remain responsible for any information shared in this way.
INTERNAL. Your Information may be shared within the Change Heroes group of companies, whether such companies are parent companies, subsidiaries, joint ventures, or other companies in common control, on a worldwide basis. All such entities shall honour this Privacy Policy in their use of Your Information.
TRANSFERS. We may disclose and transfer Your Information to a third party who acquires any part of or all of Change Heroes or the Sites, whether such acquisition is by way of merger, consolidation, or purchase of all or a substantial portion of our assets. You acknowledge that such transfers may occur, and that any acquirer of Change Heroes, the Sites or its assets may continue to use Your Information provided such use complies with this Privacy Policy.
DISCLOSURE. We disclose information if at our discretion following a request from a governmental entity or if we believe in good faith – after considering your privacy interests and other factors – that such action is necessary to: (a) meet legal requirements or comply with legal process; (b) protect our rights or property or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of our Users or the public.
Your Information is submitted to Change Heroes, a provincially incorporated company in British Columbia, Canada, and may be hosted and stored in a database on servers situated in the United States, which may be owned and maintained by a third party unrelated to Change Heroes.
Change Heroes takes reasonable measures to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. We have put in place commercially reasonable and appropriate physical, electronic and managerial procedures to safeguard and secure the Your Information. However, the Internet is an open system and we cannot guarantee that unauthorized third parties will not be able to defeat those measures or use Your Information for improper purposes. We therefore disclaim any and all liability that may arise from such incidences of security breach.
We use “cookie” technology to help personalize and maximize your online experience while using the Services. Cookies are small amounts of data that are transferred from our server to your computer’s hard drive. We use cookies to improve your experience on the Sites. If you do not wish to accept cookies, you have the option of blocking or disabling cookies. Your computer provides you with the ability to clear all cookies that have been stored onto your hard drive, should you wish to do so. However, please be aware that you may be unable to access certain parts of the Services if you block or disable our cookies.
You may receive communications from Change Heroes about products and services that may be of interest to you. If you do not want to receive such communications, you may opt-out by clicking “Unsubscribe” in any such communication, or by contacting us at [email protected]. Even if you choose to not receive such communications, we may still communicate with you regarding your use of the Services or to provide you with appropriate notification for any amendments to the Agreement or this Privacy Policy. Further to the Agreement, opt-out may not be available for Project Updates.
THIRD PARTY POLICIES. The Services may contain links to other websites that are not owned or controlled by Change Heroes. The provision of such links is for your convenience and does not signify our endorsement of such websites or their contents. Change Heroes is not responsible for the privacy policies or practices of such other websites. We have no control over, do not review and are not responsible for the privacy policies of, or content displayed on, such other websites. Please be aware that the terms of this Privacy Policy do not apply to any outside or third party websites. Therefore, you may wish to review the privacy policies of those websites so you can understand how they collect, use and share your information.
THIRD PARTY COOKIES. We may allow third parties to display advertisements to you while you are using the Services. Because you web browser must request these advertisements from such third parties servers, the third parties can view, edit or set their own cookies, just as if you had requested a web page from their website. Change Heroes has no control over, and is not responsible for, the practices of those third party advertisers. The data stored in these cookies is anonymous and the information is not linked to you personally identifiable information without your permission. The cookies placed by our third party advertisement servers may remain on your computer after you have left our site until you choose to delete them.
We take child protection very seriously. Many of the causes that Users fundraise for using our Services are to support children’s rights across the world. So we are committed to doing our part also, and that means, ensuring that the data of minors is not collected and shared inappropriately. While we recognize that minors may wish to use the Services for their fundraising projects, for their protection, we prohibit their use unless they have the consent and supervision of their parent or legal guardian.
If you are under the age of 13, you may only use the Services if your parent or guardian does so on your behalf. If you are under the age of 18 (or the ‘age of majority’ as such term is defined in your home jurisdiction, whichever is greater) then you may only use the Services with the permission and supervision of your parent or legal guardian.
If a parent or guardian becomes aware that his or her child has used the Services without consent, the parent or legal guardian should contact us at [email protected] so that we can immediately remove the child’s information from our Sites and databases.
Subject to the terms herein, you may access, review, correct, update or change your User Content and any personally identifiable information at any time. Sign in to your account to make the desired changes or contact us at [email protected].
Notwithstanding the foregoing, and further to Section 3.3, you understand that your User Content may be shared with Partners. While we will make best efforts to ensure your User Content is edited or deleted according to your instructions, you understand that our Partners may require static copies to persist so as to verify charitable contributions with the Canada Revenue Agency, the Internal Revenue Service, or another authority of similar interest in charitable transactions. As such, any edits or requests to delete User Content may not immediately affect&nbsnbsp;any permitted copies held by applicable Partners.
You may submit a request to us to permanently delete your personally identifiable information at any time. To make such a request, contact us at [email protected].
We may indefinitely retain certain non-personally identifiable information associated with your User Content for research and development, and marketing purposes.
You may withdraw your consent to this Privacy Policy at any time. To revoke your consent, please contact us at [email protected]. If you revoke your consent, your Campaigns will be closed and your personally identifiable User Content will be deleted. If you continue to use the Services, or any part thereof, your consent to this Privacy Policy and the Agreement will be renewed.
CHANGES TO THE PRIVACY POLICY.
EFFECT OF CHANGES. You understand that any changes we may make to this Privacy Policy may affect our use and disclosure of Your Information collected prior to such changes. If you do not agree to any of the changes, you must notify us prior to the effective date of the changes in order to withdraw your consent from the updated Privacy Policy, according to Section 12 of this Privacy Policy.
